Important Notice — Binding Arbitration & Class Action Waiver
These Terms include a binding arbitration agreement and a waiver of the right to participate in class actions. Please read Section 22 carefully.

Introduction & Agreement

This website is operated by ANJ Appliances & Outdoor Living (referred to as “ANJ Appliances,” “we,” “us,” or “our”). These Terms and Conditions (the “Terms”) govern your access to and use of our website, mobile applications, SMS/text messaging services, email communications, and any other online services that link to these Terms (collectively, the “Site”).

By visiting the Site and/or purchasing something from us, you engage in our Service and agree to be bound by these Terms and our Privacy Policy, including any additional policies referenced or available by hyperlink. These Terms apply to all users, including browsers, vendors, customers, merchants, and contributors of content.

If you do not agree to these Terms or our Privacy Policy, do not use the Site or Services.

Eligibility & Your Account

• Eligibility. You must be at least the age of majority in your state or province to use this Site. If you allow a minor to use the Site, you are responsible for their activities.

• Account Security. You are responsible for all activity that occurs under your account. You agree to provide current, complete, and accurate information and to keep it updated. Notify us immediately of any unauthorized use.

Updates to Terms & Site Changes

We may update or replace these Terms at any time by posting updates on the Site. It is your responsibility to check this page periodically. Continued use after changes constitutes acceptance. We may also modify or discontinue any part of the Site, products, or services without notice and without liability.

Store & Online Purchase Terms

By agreeing to these Terms, you represent that you are of legal age and will not use our products for any illegal purpose or violate any laws in your jurisdiction.

We reserve the right to refuse service, limit or cancel quantities, or restrict sales to any person, household, or jurisdiction at our discretion. We may require proof of identity or payment verification to combat fraud or unauthorized resale.

Product Information, Pricing & Availability

• Accuracy. We make every effort to display accurate descriptions, prices, and images. However, typographical errors, inaccuracies, or omissions may occur. We reserve the right to correct these and cancel or refuse orders affected.

• Changes. Prices and availability may change without notice. Any offer on the Site is void where prohibited.

• Professional Installation. For gas, electric, and built-in appliances, always follow the manufacturer’s installation manual and local codes. Installation must be performed by a licensed professional. Improper installation may result in damage or injury.

Orders, Payment & Taxes

You agree to provide accurate billing and account details. We may refuse or cancel orders suspected of fraud or resale. You authorize us (or our processor) to charge your payment method for all amounts including taxes, shipping, and fees.

Shipping, Risk of Loss & Inspection

• Methods & Processing. Orders ship via parcel carriers (UPS, FedEX or USPS) or LTL/freight based on size/weight. In‑stock items: usually depart the warehouse in 1–2 business days while typical arrival is within 7–14 days

• Free Ground Shipping — $299+ (Contiguous U.S.). Eligible orders with a merchandise subtotal of $299 or more (after discounts, before tax) ship free via standard ground or LTL/freight to the 48 contiguous United States. Exclusions may apply:  shipments to AK/HI/PR/US territories/APO/FPO, remote or limited‑access locations, white‑glove/inside delivery, assembly, and any brand‑specific freight surcharges. We reserve the right to assess additional freight on deliveries requiring special equipment or access (you will be notified by us of the extra charges and will have the opportunity to cancel the order wth no penalty fees if you do not agree with the extra charge). Orders under $299 will ship at a flat rate of 14.95 via UPS, FedEx or USPS within the contiguous United States.

• Freight/LTL Deliveries (Curbside). Residential freight includes curbside delivery; liftgate is provided where available. Appointment windows are set by the carrier. Inside delivery, stair carries, debris removal, or assembly are not included unless purchased.

• Inspection & Damage. You must inspect all freight before signing the Bill of Lading. Note any visible damage or shortage on the delivery receipt and take photos before the driver departs. For concealed damage, notify us within 48 hours (and in all cases within the carrier’s claim window) with photos and order details so we can assist with a claim/replacement.

• Risk of Loss. Title and risk of loss pass upon delivery to the shipping address you designate. If an order is refused for reasons other than carrier‑verified damage or our error, re‑delivery, return freight, and restocking fees (15%) may apply.

• Address Changes & Access. Reconsignment/redirects after shipment, unreachable delivery locations, missed appointments, or access limitations (gates, elevators, narrow streets) may incur carrier fees.

Returns & Refunds

Returns are governed by our Return Policy, which specifies restocking fees, eligible products, RMA process, and refund timing. Returned products must be new, unused, and in original packaging, unless defective under warranty.

Warranties & Disclaimers

• Manufacturer Warranties. Most products are covered solely by the manufacturer’s limited warranty. Warranty service, part availability, and eligibility (including commercial/residential use and proper installation) are controlled by the manufacturer. We will assist with warranty contacts and documentation, but the manufacturer’s terms govern (we do not offer warrenty plans directly, only warrenty is from manufacturer.

• Brand Summaries (Convenience Only). We may provide brand‑level warranty summaries (e.g., Fire Magic, TrueFlame, Tagwood). These summaries are for convenience only and do not modify the manufacturer’s official warranty. Always consult the latest warranty card or manual provided by the manufacturer. • Installation & Use. Warranties generally require licensed professional installation, use in accordance with the owner’s manual, and no unauthorized modifications (including fuel conversions without the approved kit).

• Site & Service Disclaimer. We do not guarantee that our service will be uninterrupted, timely, secure, or error‑free. The Site and all products/services are provided “AS IS” and “AS AVAILABLE,” with no warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, title, or non‑infringement), except where prohibited by law.

Limitation of Liability

To the maximum extent permitted by law, ANJ Appliances will not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, revenue, data, or replacement costs), whether in contract, tort (including negligence), or otherwise, arising from your use of the Site or any products. Our total liability shall not exceed the greater of $100 or the amount you paid for the product giving rise to the claim.

California Waiver (Section 1542). You waive California Civil Code §1542 to the extent permitted by law.

User Content, Reviews & Feedback

You may submit reviews, photos, and other content (“User Content”). By submitting, you grant us a worldwide, perpetual, irrevocable, sublicensable, royalty-free license to use, modify, and display your content. You represent that you own or control all rights and that your content does not violate any law or third-party rights.

We may remove content that we deem unlawful, offensive, or in violation of these Terms. You may not impersonate others or post misleading or harmful content.

Prohibited Uses

You may not use the Site or its content: (a) for unlawful purposes; (b) to infringe intellectual property; (c) to harass, abuse, defame, or discriminate; (d) to submit false or misleading information; (e) to upload malware; (f) to collect personal data without consent; (g) to spam, scrape, or phish; or (h) to interfere with the Site’s security. We may terminate access for any violation.

Intellectual Property & DMCA

All trademarks, logos, and content on the Site are the property of ANJ Appliances or our licensors. You may not reproduce, distribute, or create derivative works without written consent.

Third-Party Tools & Links

We may provide links or access to third-party websites, services, or tools. These are provided “as is” without warranties, and we are not responsible for third-party content, policies, or practices. Use them at your own risk.

Mobile & SMS/Text Messaging

By consenting to our SMS/text service, you agree to receive recurring messages, including order updates and marketing offers, to the number provided. Message and data rates may apply. Consent is not a condition of purchase. Text STOP to cancel or HELP for support. Carriers are not liable for delayed or undelivered messages.

Privacy & Data Use

Your submission of personal information through the Site is governed by our Privacy Policy, which explains how we collect, use, and protect your data.

Indemnification

You agree to indemnify, defend, and hold harmless ANJ Appliances, its affiliates, officers, employees, and agents from any claim or demand (including attorneys’ fees) arising from your breach of these Terms, your violation of law, or your infringement of third-party rights.

Severability

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted.

Termination

These Terms remain effective until terminated by either you or us. We may suspend or terminate your access at any time without notice for any violation. Provisions that should survive termination (such as intellectual property rights, disclaimers, and limitations of liability) will remain in effect.

Governing Law & Venue

These Terms and any transactions are governed by the laws of the State of Florida, without regard to conflicts of law, and applicable federal law. Subject to the arbitration provision in Section 21, the exclusive venue for any permitted court action is the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction there.

Dispute Resolution — Binding Arbitration & Class Action Waiver

Please read carefully. You and ANJ Appliances agree to resolve any dispute or claim arising from or relating to these Terms or the Site through binding arbitration administered by JAMS, under its Streamlined rules for claims under $250,000 and Comprehensive rules otherwise.

• Individual Basis. Disputes will be resolved only on an individual basis, and class or collective actions are not permitted.

• Opt-Out. You may opt out of arbitration by sending written notice to {{ legal@yourdomain.com }} within 30 days of first accepting these Terms.

• Small Claims. You may bring qualifying claims in small claims court.

• Time Limit. Any claim must be filed within one year of arising.

If any part of this section is found unenforceable, the remainder will still apply.

Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including acts of God, labor disputes, supply chain disruptions, carrier failures, utility outages, government actions, or severe weather.

Entire Agreement & Miscellaneous

These Terms, along with our Privacy Policy and any other referenced policies (Return, Shipping, Warranty), constitute the entire agreement between you and ANJ Appliances and supersede prior agreements. Failure to enforce any right is not a waiver. Section headings are for convenience only.

A. Shipping & Freight Policy (Summary).

• Scope, processing times, and methods (parcel vs. LTL).

• Free Ground Shipping on $299+ orders (eligible items, contiguous U.S.) and the listed exclusions. Orders under $299 ship at a flat rate of $14.95 via UPS, FedEx or USPS.

• Freight delivery is curbside; liftgate where available; optional inside/white‑glove services extra.

• Inspection, damage/shortage reporting timelines, and claim assistance.

• Re‑delivery, reconsignment, access limitations, and associated carrier fees.

B. Warranty Policy (Summary).

• Manufacturer‑controlled coverage and remedy; brand summaries are convenience only.

• Proof of purchase and licensed professional installation may be required.

• Exclusions for misuse, improper installation, or unauthorized modifications.
